By subscribing to the ATHINA service (“Service”), you (“ATHINA User”) agree to be bound by the following terms and conditions (“Terms of Service”). I, ACCOUNT TERMS
- You must be 20 years of age or older or at least the age of majority in the region where you reside or where you use this Service.
- You must provide your full legal name, current address, valid email address, and any other information necessary to complete the registration process.
- You acknowledge that ATHINA will use the email address you provide as your primary method of communication.
- You are responsible for keeping your password and authentication account (such as “Login with Facebook”) secure. ATHINA cannot and will not be responsible for any loss or damage caused by your failure to maintain the confidentiality of your account, password and account authentication.
- You are responsible for all activity and content such as data, graphics, photos and links uploaded in your ATHINA account (“Hosted Content”). You may not transmit viruses or any code of a destructive nature to the Service.
- Violation of any provision of the Terms of Service as determined in ATHINA’s sole discretion will result in immediate termination of your service.
II, ACCOUNT ACTIVATION
- In connection with clause 2.2, the person subscribing to the Services shall be the contracting party (“Account Holder”) for the purposes of the ATHINA Terms of Service and shall be the person authorized to use any respective account that we may provide to the Owner Account in connection with the Services.
- If you register for the Services on behalf of your company, your company will be the Account Holder. If you are registering for the Services on behalf of your employer, you represent and warrant that you have the authority to bind your employer to our Terms of Service.
- You are responsible for granting account access only to representatives authorized to adequately represent the Account Holder. Any actions or activities under your account are deemed to be performed on behalf of the Account Holder. Only Account Holders or their authorized representatives are authorized to use ATHINA.
- After completing your registration for the Service, you acknowledge that ATHINA will retrieve the necessary information on your behalf from Facebook or/and other platforms. You are solely responsible for those actions. Do not create an account or retrieve information if it violates any laws in your jurisdiction.
III, LIMITATION OF LIABILITY
- You expressly understand and agree that ATHINA shall not be liable for any direct, indirect, incidental, special damages, including but not limited to, damages for loss of profits, goodwill, use rights, data or other intangible damages due to use or inability to use the service.
- In no event shall ATHINA or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our website , our services or this agreement (including those arising from negligence). You agree to indemnify and hold us and (if any) ATHINA’s parent companies, subsidiaries, affiliates, partners, officers, directors, agents and employees, harmless from any claim or any claim, including reasonable attorneys’ fees, made by any third party or arising out of your breach of this Agreement or the documents it incorporates by reference, or your breach of any law or third party rights.
- You are solely responsible for your use of the service. The Service is provided on an “as is” and “as available” basis without any warranties or conditions of any kind, express, implied or statutory.
- ATHINA does not guarantee that the Service will be uninterrupted, timely, or secure.
- ATHINA does not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
- ATHINA does not warrant that the quality of any products, services, information or other material purchased or obtained by you through the Service will meet your expectations, or that any errors in the Service will be corrected. repair.
IV, WAIVER AND COMPLETION OF AGREEMENT
The failure of ATHINA to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. - By uploading Store Content, you agree to: (a) allow other internet users to view your Store Content but not your backend dashboard and personal information; (b) to allow ATHINA to display and store your Store Content; and (c) that ATHINA may, at any time, review all Store Content that you have submitted to the Service.
- You retain ownership of all Store Content that you upload and import into ATHINA’s store; However, by posting public comments or uploading public information, you agree to allow others to view your content. You are responsible for compliance of the content with any applicable laws or regulations.
- We will not disclose your confidential information to third parties, except as required in the course of providing our services and to carry out the activities described in section 4.5. Confidential Information includes any documents or information provided by you to us that are not made public. Confidential Information does not include information that: (a) is in the public domain at the time we receive it; (b) is placed in the public domain after we receive it through no fault of ours; (c) we receive from someone other than you without breach of our or their confidentiality obligations; or (d) we are required by law to disclose it.
V, CANCELLATION AND TERMINATION
- You can cancel your account at any time by creating a reset ticket on the application and then following the specific instructions indicated to you in ATHINA’s response.
- Once cancellation is confirmed, all of your information will be deleted from the Service. We reserve the right to keep your information inaccessible due to technical limitations.
- We reserve the right to modify or terminate ATHINA’s services for any reason without notice at any time.
- Fraud: Without limiting any other remedies, ATHINA may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation , or otherwise) have engaged in fraudulent activity in connection with the Site or any part of the ATHINA Services. You shall be liable for ATHINA’s lost profits, fees, costs or any special, incidental or consequential damages related to fraudulent activity.
